Pallmeyer: Plaintiff D6EA9B7 objects to the courts May 28, 2010 order, in which the court granted Defendants motion for an extension of time. He asserts that he did not receive a copy of that motion and therefore had no opportunity to object. The court recognizes that Plaintiffs incarcerated status makes it impossible for him to appear in court and that he does not always receive mail promptly. This is the reason the court ordinarily conducts telephone conferences in cases involving unrepresented prisoners. Plaintiff D6EA9B7 has refused to participate in such conferences, however. In any event, Plaintiff has no specific objections to Defendants motion, and Defendants have in fact now responded in part to the courts earlier direction, in its May 7 order, that Defendants provide certain additional discovery responses. In the response filed on June 17, 2010, Defendants report that the Keeper of Records for IDOC has reviewed their personnel files and found no records of misconduct during the relevant time period (November 2005 through November 2007). Regrettably, Defendants have not yet complied with the second part of the courts May 7 order: The court there directed that Defendants furnish a sworn statement from relevant Stateville official(s) regarding the institutions record-keeping practices and explain why no central filing system exists that would reveal the existence of other complaints regarding the matters of which Plaintiff complains in this lawsuit.
