Chang: Plaintiff has moved to proceed in forma pauperis [R. 4], and submitted an application in support. In the application, Plaintiff alleges under oath that she has no income other than a $300 monthly income in rent and no other cash or bank accounts exceeding $200. Yet in Plaintiff's complaint [R. 1], she alleges that she has used the trademark "Eryka Kane" "in digital and sound recordings since 1999," implying some source of income. Indeed, the complaint alleges that Plaintiff has "sold over 1,750,000 records" using that and other trademarks. If Plaintiff wishes to proceed in forma pauperis, Plaintiff must, on or before 05/02/2011, file an affidavit under oath as a supplement to the in forma pauperis application. The affidavit must specifically explain how the allegations in the complaint are consistent with the in forma pauperis application. Failure to file the affidavit will result in denial of the application, and the Court will then set a date for payment of the filing fee. With regard to Plaintiff's motion for appointment of counsel [R. 5], the motion is denied for a reason independent of the uncertain in forma pauperis status, namely, that Plaintiff's motion does not indicate any attempt to enlist free legal representation from any legal services organization. The denial is without prejudice to re-applying if Plaintiff is in fact indigent, makes reasonable efforts to obtain legal representation, and otherwise shows that appointment of counsel is appropriate.
