- ilnd;;1:11-cv-02518_de7 RegisterActionDescriptionText "MINUTE entry before Honorable Edmond E. Chang: With regard to Plaintiff's motion for protective order and to proceed under a pseudonym [R. 5], the Court will take the motion under advisement and give Defendants, after service of the complaint, an opportunity to respond. Until resolution of the motion, however, Plaintiff may continue to make any filings under the pseudonym. Separately, the Court makes the following jurisdictional inquiry: the complaint relies on diversity of citizenship, generally alleging that the parties are citizens of different states, but specifically alleges that Plaintiff "is a resident of Maryland," that Defendant MSC is "headquartered in Aurora, Illinois," and that Defendant Philip DeRea "resides in Aurora, Illinois." But residency is not the same as citizenship for diversity jurisdiction purposes. Hunter v. Amin, 583 F.3d 486, 491 (7th Cir. 2009). Moreover, a corporation's citizenship is determined by its state of incorporation and its principal place of business. 28 U.S.C.A. § 1332(c)(1). If Plaintiff intended to allege, as it must for diversity jurisdiction purposes, that the individual Plaintiff and Defendants were citizens of the states identified in the complaint, the Plaintiff may amend the complaint on or before April 20, 2011.Mailed notice (Attachments: # 1 Minute Order) (slb, ) (Entered: 04/15/2011)" @default.
