- ilnd;;1:11-cv-04401_de105 RegisterActionDescriptionText "ORDER: Plaintiff's counsel is directed to review the allegations in Plaintiff's amended complaint in Riley-El v. Officer Carter, No. 13 C 5773 (N.D. Ill.) (Gottschall, J.), and determine if the allegations therein are related to and/or a continuation of the allegations asserted in the instant case. If so, for the sake of judicial economy, the court requests that Plaintiff file an amended complaint in this case that asserts all his allegations that Stateville officials and officers provided inadequate exercise or yard time based upon Plaintiffs disability and use of a crutch. See Fed. R. Civ. P. 15(d) (the court may, on just terms, permit a party to serve a supplemental pleading setting out any transaction, occurrence, or event that happened after the date of the pleading to be supplemented); Maharaj v. Bankamerica Corp., 128 F.3d 94, 97 (2d Cir. 1997) (if, after the first suit is underway, a defendant engages in actionable conduct, a plaintiff may file an amended complaint to include allegations about such subsequent conduct). If the claims in these two cases are not related and do not belong in the same suit, Plaintiff's counsel shall so notify the court. Signed by the Honorable Joan B. Gottschall on 1/24/2014. Mailed notice (ef, ) (Entered: 01/24/2014)" @default.
