- ilnd;;1:11-cv-04450_de7 RegisterActionDescriptionText "MINUTE entry before Honorable Amy J. St. Eve: Plaintiff's motion for reconsideration 6 is denied. The Court remains satisfied that Plaintiff has no actionable claim under 42 U.S.C. § 1983. As discussed more fully in the Court's prior order, any civil cause of action relating to conviction is time-barred; police officers acting as witnesses have absolute immunity from suit; judges cannot be sued for actions taken in their official capacity; state's attorneys have absolute immunity for prosecuting an individual; defense attorneys are not state actors for purposes of Section 1983; malicious prosecution is not actionable in federal court; and an inmate may not challenge a criminal conviction by way of a civil rights action. The Court is not persuaded that it made a manifest error of law or fact in dismissing this case, and there is no newly discovered evidence presented in Plaintiffs present motion to change this view. See, e.g., Abcarian v. McDonald, 617 F.3d 931, 943 (7th Cir. 2010). Accordingly, the Court's Minute Order of July 7, 2011, stands. The case remains closed. Plaintiff is reminded for reference in future cases that he is required to provide the Court with the original plus a judges copy of every document filed.Mailed notice (kef, ) (Entered: 07/28/2011)" @default.
