In that motion, Plaintiff contends that pro se Defendant Wallis wrongfully removed this case to federal court. Plaintiff asks this Court to remand the case to state court and to order Defendant Wallis to pay Plaintiffs costs and attorneys fees (see 28 U.S.C. § 1447(c)). Plaintiffs motion 8 is taken under advisement and the following briefing schedule is set: Defendant Wallis is given until 8/22/2011 to respond to the motion; Plaintiff is given until 9/6/2011 to file a reply, if any. In his response brief, Defendant Wallis should address (along with any other arguments that he may wish to make) whether, in the event that the Court grants Plaintiffs motion, his pro se status and financial circumstances (as set forth in his financial affidavit [see 5]) bear on the propriety of awarding costs and/or attorneys fees. Because Defendant Wallis did not incur any filing fees in connection with the removal of this case, his in forma pauperis application 5 is denied as moot. In view of this minute order, the notice of motion date of 7/26/2011 is stricken and no appearances are necessary on that date.
