- ilnd;;1:11-cv-07987_de7 RegisterActionDescriptionText "MINUTE entry before Honorable Gary Feinerman: Defendants are ordered to show cause, by 11/28/2011, why this case should not be remanded for want of subject matter jurisdiction to the Circuit Court of Cook County. The notice of removal 1 premises subject matter jurisdiction under the Class Action Fairness Act, 28 U.S.C. § 1332(d), but does not properly allege the citizenship of either Defendant. Defendants may discharge the order by filing a pleading styled "Jurisdictional Addendum to the Notice of Removal." The addendum must properly allege the citizenship of Defendants, both of which are LLCs; to do so, the addendum must identify (by name) each member of each LLC and specify the citizenship of each member. See Thomas v. Guardsmark, LLC, 487 F.3d 531, 533-34 (7th Cir. 2007); Guaranty Nat'l Title Co., Inc. v. J.E.G. Assocs., 101 F.3d 57, 58 (7th Cir. 1996). Defendants should note that the citizenship of each LLC must be traced through multiple levels of ownership if the LLC's members are themselves LLCs or partnerships. See Mutual Assignment and Indemnification Co. v. Lind-Waldock & Co., LLC, 364 F.3d 858, 861 (7th Cir. 2004). Initial Status Report shall be filed by 12/7/2011. Initial status hearing scheduled for 12/14/2011 at 9:00 a.m. Please see Judge Feinerman's web page (http://www.ilnd.uscourts.gov, to "District Judges," to "Judge Gary Feinerman," to "Initial Status Hearings" under Case Management Procedures) for details on the initial status hearing and Initial Status Report.Mailed notice.
