- ilnd;;1:15-cv-04225_de12 RegisterActionDescriptionText "MINUTE entry before the Honorable Andrea R. Wood: Plaintiff's motion to proceed with discovery 10 is denied. Federal Rule of Civil Procedure 26(d) provides that "a party may not seek discovery from any source before the parties have conferred as required by Rule 26(f)" unless one of certain specified conditions are met, one of which is that permission has been granted by court order. Fed. R. Civ. P. 26(d)(1). In requesting a court order to permit early discovery in this case, Plaintiff has not provided any compelling reason why she cannot wait until after the Rule 26(f) conference to serve discovery on the defendants; she simply states that the defendants have committed "perjury amount to to [sic] material misrepresentations and omissions in her [sic] complaint in this matter." (Pl.'s Mot. at 1.) Accordingly, Plaintiff's motion is denied. After the parties have their Rule 26(f) conference, Plaintiff may conduct full discovery on the usual schedule established under the Federal Rules of Civil Procedure. Plaintiff also is reminded that the Local Rules of this Court require all motions to be accompanied by a notice of presentment specifying the date and time on which, and judge before whom, the motion or objection is to be presented. Failure to properly notice a motion may result in that motion being stricken. Plaintiff should follow this rule for all future motions. Mailed notice (ef, ) (Entered: 06/26/2015)" @default.
