Dart, No. 13 C 5874, and informed the Court that due to the burden of presenting the affirmative defense of exhaustion in the remaining Division III and Division III Annex cases, it will no longer seek to present the defense and therefore concedes exhaustion. All Pavey hearings that are currently scheduled are terminated. All exhaustion discovery is terminated. All counsel who have been recruited for the sole purpose of challenging the affirmative defense (a/k/a Pavey counsel) are permitted to withdraw at this time. Any counsel who has agreed to maintain the matter for purposes of the merits of the case shall remain counsel. If Pavey counsel seeks to withdraw, s/he shall file an unopposed motion to withdraw based on this case management order by November 30, 2015.
