With respect to ESI, the motion is granted and the parties are to meet and confer regarding a protocol for searching for, identifying and collecting emails and other electronically stored information (including ESI related to the conception, design, and development of the Accused Sweeps). By 11/23/2020, the parties are to file a Joint Status Report ("JSR") setting forth their agreed ESI protocol and schedule, or the parties' proposed alternatives. The JSR is also to include (1) agreed dates for Rule 30(b)(6) depositions (the deadline for such depositions is extended to 12/4/2020), (2) any disputes over the Rule 30(b)(6) deposition topics; (3) a proposed deadline for Defendants to produce documents regarding the conception, design, and development of the Accused Sweeps (aside from ESI); and (4) a potential new deadline to complete depositions that have been started but not completed due to delay in the production of outstanding written discovery that has been the subject of a motion to compel. Defendants' request to extend the fact discovery deadline by 45 days is denied; however, the Court will be setting new deadlines for the completion of discovery already in process that has been delayed to await a ruling on a motion to compel. Defendants' Motion for Protective Order Shifting Discovery Expenses to Plaintiff 221 is denied for reasons stated on the record.
