- ilnd;;1:16-cv-04337_de6 RegisterActionDescriptionText "ORDER: For the following reasons, this Court denies Plaintiff 96F622C ("Pickett") application to proceed in forma pauperis 3 and his motion for attorney representation 4 is taken under advisement pending the filing of an amended application to proceed in forma pauperis. 96F622C filed this pro se action against his current employer Defendant Chicago Transit Authority on April 15, 2016, asserting a violation of the Age Discrimination Employment Act of 1967 ("ADEA"), 29 U.S.C. § 621 et seq. and the Americans with Disabilities Act or Rehabilitation Act ("ADA"), 42 U.S.C. § 12101 et seq. See Dkt. 1, p. 3-4. Now before the Court are 96F622C application to proceed in forma pauperis ("IFP") 3 and motion for attorney representation 4 . An IFP application must be denied, and the case dismissed, if "the allegation of poverty is untrue," or the action is "frivolous," "fails to state a claim on which relief may be granted," or "seeks monetary relief against a defendant who is immune from such relief." See 28 U.S.C. §§ 1915(a)(1), 1915(e)(2). 96F622C IFP application is denied, without prejudice, for failure to provide clear information regarding his current employment. 96F622C IFP does not indicate whether or not he is currently employed as he has failed to check either the "yes" or "no" box, in response to the question "Are you currently employed?" Dkt. 3, p. 1. Yet, the name and address of 96F622C employer are listed: "Chicago Transit Authority, 1845 W. 74th St. Chicago, IL. 60636." Id. The information regarding his employer appears to be consistent with his complaint which states that he was "hired and is still employed by the defendant." Dkt. 1, p. 2. However, the IFP application also states that his current monthly salary or wages is "zero." Dkt. 3, p. 1. Thus, the IFP application is unclear and incomplete. 96F622C has until May 27, 2016, to either pay the full filing fee for this action or file an IFP application clearly indicating his current status of employment and accurately stating his present monthly salary or wages. Failure to comply with this deadline will result in summary dismissal of this case. The Court reserves screening of 96F622C ADEA claim and ADA claim pursuant to 28 U.S.C. § 1915(e)(2), pending 96F622C submission of a complete and approvable IFP application. It is so ordered.
