Kennelly: Plaintiff has taken ten depositions in this case and asks to take four more, of witnesses named Nowinski, Sheridan, Bryant, and Hogan. Plaintiff argues that the case is complex and involves a large number of employment-related decisions in which different City of Chicago personnel were involved. There is no serious dispute over the importance of Nowinski, so the Court will permit that deposition. As for the other three witnesses, defendant argues, in essence, that they have no relevant knowledge--but it has refused plaintiff's proposal to commit not to use them as witnesses at summary judgment or trial. This is more than a little bit inconsistent. That said, the Court declines to permit the depositions of Sheridan, Bryant, or Hogan at this time and therefore denies plaintiff's motion to that extent. However, if defendant offers an affidavit from any of these witnesses in connection with summary judgment or lists any of them as a will-call or may-call witness during preparation of the final pretrial order, defendant will be required to produce the witness for a deposition within seven days of submitting the witness's affidavit or listing the witness as a will-call or may-call witness for trial. Finally, at this morning's status hearing, the parties should be prepared to discuss a schedule for disclosure and discovery of expert witnesses as well as a deadline for dispositive motions.
