The obligation to pay the filing fee is statutory (i.e., required by an Act passed by Congress, 28 U.S.C. § 1915(b)(2)) and is extinguished only when the fee is paid in full. See Bruce v. Samuels, 136 S. Ct. 627, 632 (2016) (holding that the Prison Litigation Reform Act "calls for assessment of an initial partial filing fee each time a prisoner brings a civil action or files an appeal" and ongoing monthly installment payments thereafter); see also Jackson v. Foster, No. 14-CV-1194-PP, 2015 WL 5918624, at *1 (E.D. Wis. Oct. 9, 2015) ("Parties pay a filing fee for the privilege of filing the complaint. The plaintiff filed a complaint. Thus, he owes the filing fee...."). The Court acknowledges Plaintiff's receipt of approximately $90 per month from family members and his desire to conserve these funds for discretionary purchases. However, when weighing the balance between leaving an inmate without money for amenities and following statutory requirements for the payment of filing f ees, the latter wins out, particularly in light of the fact "that prisons are constitutionally bound to provide inmates with adequate food, clothing, shelter, and medical care and must furnish paper and pen to draft legal documents and stamps to mail them." Bruce, 136 S. Ct. at 632. Plaintiff's request to waive the remaining portion of the filing fee 21 is, therefore, denied. Signed by the Honorable Matthew F. Kennelly on 11/7/2018.
