The medical records provided by the government, if the Court is reading them correctly, appear to support this. See dkt. no. 64, ECF p. 25 of 28 (appearing to indicate that an albuterol inhaler was "discontinued" on 4/23/2020). The first page of the records, which appears to list dispensation of medications, is rather cryptic but does not appear to reflect dispensation of the ProAir inhaler (which is an albuterol inhaler) on any recent date. Between now and the time of the hearing, the government and (if possible) defense counsel are requested to make best efforts to ascertain whether Mr. Ayers currently has actual access to an inhaler for his asthma, and if not, why not.
