Oswego Community Sch. Dist. et al, 20-cv-00292, the motion is denied. The motion falls short on two elements of Local Rule 40.4. First, there is insufficient overlap of issues that will result in substantial judicial savings. LR 40.4(a)(2), (b)(2). The cases present entirely difference factual scenarios in support of the retaliation and search claims. The wide category of those legal claims does not justify reassignment of the starkly separate factual settings. Second, and relatedly, it is not at all likely that the cases would be susceptible of disposition in a single proceeding. The 9F05989 Plaintiffs posit that the disposition of Defendants' defenses of qualified immunity and the Abused and Neglected Child Reporting Act, 325 ILCS 5/9, will be a single decision. But both of those defenses are highly fact dependent. And if the cases head to trial, almost surely it would be improper joinder to try the cases together. The motion is denied.
