- ilnd;;1:19-cv-01480_de9 RegisterActionDescriptionText "ORDER. Plaintiff 6C26CF6 has submitted to this Court a letter 11 , which the Court construes as a motion seeking clarification of its March 4, 2019 Order dismissing this case. The motion is granted. The Court clarifies that plaintiff's complaint is frivolous because it lacks an arguable basis in fact or law: (1) the allegations are fantastic, fanciful, and no reasonable person could believe them, see Denton v. Hernandez, 504 U.S. 25, 32 (1992); Lee v. Clinton, 209 F.3d 1025, 1026 (7th Cir. 2000); and (2) even if the complaint's allegations are true, it does not even arguably state a claim for relief because this Court has no power to compel a United States senator to restrict the actions of the United States military (which, of course, no senator has any power to do, anyway), see Ashcroft v. Iqbal, 556 U.S. 662, 678-80 (2009) (the court should "draw on its judicial experience and common sense" when determining if a complaint states a plausible claim for relief). This case remains closed. Signed by the Honorable Jorge L. Alonso on 3/12/2019. Notice mailed by judge's staff (ntf, ) (Entered: 03/12/2019)" @default.
