- ilnd;;1:19-cv-01791_de51 RegisterActionDescriptionText "ORDER: Defendants have filed a motion under case caption 19 C 1791 to supplement the record on appeal in Appeal No. 20-1635, see Case No. 19 C 1791, Dkt. 47 , with a CD that was an Exhibit to a motion filed in Case 19 C 1791, see No. 19 C 1791, Dkt. 30 . Appeal No. 20-1635 is an appeal from the dismissal of Case No. 18 C 6139, but as Defendants explain, Cases 19 C 1791 and 18 C 6139 (along with several other of Plaintiff's cases) were dismissed together via one omnibus order, and the telephone calls on the CD were a large basis of that omnibus dismissal. Because the contents of the CD were a large basis of the dismissal of Case 18 C 6139, Defendants' motion to supplement, see No. 19 C 1791, Dkt. 47 , is granted. However, Clerk's office staff has informed this Court that Defendants did not file a copy of the CD with the Clerk's Office. (Defendants transmitted only a courtesy copy of the CD to this Court's chambers.) Accordingly, Defendants are directed in a manner that is consistent with public health and safety to file a copy of the CD in the Clerk's Office for both Cases 19 C 1791 and 18 C 6139, and to also file certificates of service on the dockets for both cases confirming the filing. Once the certificates of service are filed, the Court will direct the Clerk's Office to transmit the CD to the Seventh Circuit for inclusion in the record on appeal in Appeal No. 20-1635. Signed by the Honorable Virginia M. Kendall on 9/17/2020. Mailed notice(gcy, ) (Entered: 09/17/2020)" @default.
