- ilnd;;1:19-cv-05650_de13 RegisterActionDescriptionText "ORDER: On October 21, 2019, the United States Marshals Service returned summons unexecuted for Defendant Roman, explaining "Refused. Multiple C/O with same last name during complaint timeline" 8 . Service of process therefore has not been effectuated on Roman. Plaintiff cannot obtain damages from a defendant unless he serves the defendant or obtains a waiver of service in accordance with Federal Rule of Civil Procedure 4. Plaintiff therefore must determine Roman's full name or obtain other identifying information so that service may be effectuated. All remaining defendants have been served. Plaintiff therefore is advised to send interrogatories under Federal Rule of Civil Procedure 33 to the attorney who has appeared for Defendants in order to obtain identifying information for Defendant Roman, i.e., full name, title, or badge number. After Plaintiff has obtained identifying information for Roman, he may submit a motion to this Court requesting that the Court issue alias summons for service on Roman. Plaintiff should do this as soon as possible in light of the two-year statute of limitations and applicable tolling rules. See Bryant v. City of Chicago, 746 F.3d 239 (7th Cir. 2014). Signed by the Honorable Virginia M. Kendall on 12/9/2019. Mailed notice. (bg, ) (Entered: 12/09/2019)" @default.
