Plaintiff's complaint 1 is dismissed without prejudice. Plaintiff's motion for attorney representation 5 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration immediately to deduct $33.22 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court requests that Eric Stephen Mattson, Sidley Austin LLP, One South Dearborn Street, Chicago, IL 60603, emattson@sidley.com, represent Plaintiff, in this case, in accordance with counsel's trial bar obligations under the District Court's Local Rule 83.37 (N.D. Ill.). Recruited counsel falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States, and therefore, counsel shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this Court for the above-captioned case and the previous cases filed in this Court by this Plaintiff (18 C 5817) only. Counsel is directed to open a separate PACER account for use in this case only. Fees are exempt for this case and the previously identified cases filed in this Court by this Plaintiff only; counsel shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this Court. This exemption is valid immediately and for the duration of counsel's participation in this matter but may be revoked at the discretion of the Court at any time. Counsel shall contact the PACER Service Center at 1-800-676 6856 or via the link below to create a new PACER account and to make any necessary arrangements for the waiver. A copy of this order shall be sent (by electronic means if available) to the following: (1) the trust fund officer at Plaintiff's present place of incarceration; (2) the Court's Fiscal Department; (3) the PACER Service Center at pacer@psc.uscourts.gov; (4) the Systems Department of the Northern District of Illinois; (5) Plaintiff; and (6) recruited counsel. Counsel is encouraged to visit the Pro Bono Resources for Trial Bar Attorneys now available on the Court's homepage for various resources related to pro bono representation. By 12/17/2019, counsel shall enter an appearance for Plaintiff. Counsel shall appear at the next status hearing and be prepared to report on the status of Plaintiff's amended complaint.
