- ilnd;;1:20-cv-01090_de9 RegisterActionDescriptionText "MINUTE entry before the Honorable Mary M. Rowland: In light of Second Amended General Order 20-0012 dated March 30, 2020, initial status hearing set for 4/16/20 is stricken and reset to 6/25/20 at 10:00am. The court notes defendants have not yet been served. Joint initial Status Report due 6/18/20. Also due on 6/18/20 is a supplemental jurisdictional statement. As to Defendant Advice Media, LLC, Plaintiff is referred to Thomas v. Guardsmark, LLC, 487 F.3d 531 (7th Cir. 2007), requiring identification of the citizenship of each of the LLC members as of the date of the complaint, and, if those members have members, the citizenship of those members. As to Defendant 1C50310, Plaintiff is reminded that allegations of residence, as opposed to citizenship, are not sufficient to establish diversity jurisdiction. Slottke v. Wis. Dep't of Workforce Dev., 734 F. App'x 354, 355 (7th Cir. 2018). For individuals, "[c]itizenship means domicile (the person's long-term plan for a state of habitation) rather than just current residence." Myrick v. WellPoint, Inc., 764 F.3d 662, 664 (7th Cir. 2014). Further, allegations of citizenship based on "information and belief" are insufficient to establish diversity jurisdiction in the Seventh Circuit. See Brickstructures, Inc. v. Coaster Dynamix, Inc., 2017 U.S. Dist. LEXIS 159681, at *2 (N.D. Ill. Sep. 28, 2017). Therefore on or before 6/18/20, Plaintiff shall file on the docket a supplemental jurisdictional statement. Mailed notice. (dm, ) (Entered: 04/02/2020)" @default.
