- ilnd;;1:20-cv-01155_de7 RegisterActionDescriptionText "MINUTE entry before the Honorable Edmond E. Chang: Upon review of the complaint, the Court orders the following jurisdictional inquiry. Plaintiff's complaint relies on diversity jurisdiction under 28 U.S.C. § 1332(a). The complaint alleges that plaintiff Automotive Credit Corporation is a Michigan corporation with its principal place of business located in Southfield, Michigan. R. 1, Compl. 1. The complaint then alleges that defendant Chicago Auto Outlet is an Illinois limited liability company with its principal place of business located in Chicago, Illinois, and lists the members at the "times relevant to the purchase and sale." Id. at 2, 23-26. But an LLC's citizenship for purposes of diversity jurisdiction depends on the citizenship of its members at the time of the suit's filing. See Wise v. Wachovia Securities, LLC, 450 F.3d 265, 267 (7th Cir. 2006) (discussing citizenship of LLCs). There is no allegation in the complaint identifying all of the members of the defendant LLC or their citizenship. Accordingly, on or before 03/23/2020, plaintiffs must either file an amended complaint fixing this problem, or otherwise file a memorandum explaining why the current complaint sufficiently alleges jurisdiction. Mailed notice (mw, ) (Entered: 03/09/2020)" @default.
