- ilnd;;1:20-cv-01191_de13 RegisterActionDescriptionText "ORDER: In February 2020, Plaintiff filed a copy of an offender authorization for payment in the amount of $400 7 , but the Clerk has not yet received payment. Thus, by order dated July 1, 2020 12 , the Court asked Stateville trust fund officials to file a status report confirming if they hadsent a check. Counsel for the Illinois Department of Corrections promptly responded via email, stated that the Business Office is current on disbursements and has no record of a $400 voucher request from Plaintiff, and provided a copy of Plaintiff's trust fund statement, which shows abalance of $3,493.91 as of July 2, 2020, as well as very substantial consistent income since Plaintiff's arrival at Stateville in 2011. The obligation to file a status report is discharged. Because Plaintiff may have attempted to pay the fee, the Court will give him a final chance to pay. By August 17, 2020, Plaintiff must send a $400 check or money order (made payable to the Clerk ofCourt) to the Clerk of Court, United States District Court, 219 South Dearborn Street, Chicago, Illinois 60604, attn: Cashier's Desk, 20th Floor. If he does not comply, this lawsuit will be summarily dismissed without prejudice. Because Plaintiff need only address his filing fee obligation at this point, his requests for counsel 4 5 are denied with prejudice, but the Courtwill revisit his requests if and when this case proceeds to screening. Plaintiff is also reminded of his ongoing obligation to conserve his funds to finance potential future litigation, Sanders v. Melvin, 873 F.3d 957, 960 (7th Cir. 2017), as discretionary purchases do not trump his obligationto pay Court filing fees, Maboneza v. Kincaid, 798 Fed. App'x 19, 21 (7th Cir. 2020). If he fails to save, he likely will be ineligible to pay in installments in any future case. The Clerk is directed to send a copy of this order to Plaintiff and Stateville's trust fund officer (electronically if possible). Signed by the Honorable Sharon Johnson Coleman on 7/2/2020.
