The Court orders the trust fund officer at the facility having custody of Plaintiff to deduct $34.20 from his account for payment to the Clerk as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. Summonses shall not issue at this time, however, as Plaintiff's complaint 1 is dismissed without prejudice to the filing of an amended complaint. The Court grants Plaintiff's motion for attorney representation 4 and requests that David Brian Nemeroff, Nemeroff Law Offices, 105 W. Madison Street, Suite 1900, Chicago, IL 60602, service@nem-law.com, represent Plaintiff, in this case only, in accordance with counsel's trial bar obligations under Local Rule 83.37. Counsel is granted until May 25, 2020 to file an amended complaint that comports with counsel's obligations under Rule 11 of the Federal Rules of Civil Procedure. Recruited counsel falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States; therefore, counsel shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this court for the above-captioned case. Recruited counsel is directed to open a separate PACER account to be used only for this case. This exemption is valid immediately and for the duration of counsel's participation in the matter, but may be revoked at the discretion of the Court at any time. Counsel shall contact the PACER Service Center at 1-800-676-6856 or pacer@psc.uscourts.gov to create the new PACER account and to make any necessary arrangements for the waiver.
