Gettleman on 6/13/2020: By order dated April 24, 2020 9 , the Court advised Plaintiff that pursuant to general orders relating to the current public health crisis, the date for him to renew his in forma pauperis (IFP) application or pay the full $400 filing fee had been extended to June 3, 2020. The Court did not dismiss this lawsuit immediately after the due date passed to allow for possible mail or docketing delays. A letter postmarked May 26, 2020, from Plaintiff 12 was just docketed. Plaintiff states that he has been released on electronic monitoring and asks for an unspecified extension so he can arrange payment. Because Plaintiff was in custody when he initiated this lawsuit, he remains subject to the Prison Litigation Reform Act, including its provisions regarding payment of the filing fee, despite the change in his custodial status. See Witzke v. Femal, 376 F.3d 744, 750 (7th Cir. 2004). His request for an extension is granted. By July 21, 2020, he must file a properly supported IFP application that accurately discloses his finances beginning twelve months before he initiated this lawsuit (in other words, February 8, 2019) and ending on the date of compliance. He may obtain certified trust fund information, as specified on the IFP form, by writing a letter to the trust fund officer at the Cook County Jail. In addition, because Plaintiff is currently at home on electronic monitoring, he must disclose how he is currently supporting himself and obtaining the basic necessities of life (such as public assistance, assistance from family, or another means). Alternatively, he may pay the full $400 filing fee. If Plaintiff does not address his fee status or seek another extension before the due date passes, the Court will summarily dismiss this case. Although Plaintiff appears to intend to pay the fee upfront, the Clerk is directed to send him a copy of the IFP form for persons in custody (because he is still subject to the Prison Litigation Reform Act) so he has it if he needs it, along with a copy of this order.
