- ilnd;;1:20-cv-01477_de7 RegisterActionDescriptionText "MINUTE entry before the Honorable Edmond E. Chang: Upon review of the complaint, the Court orders the following jurisdictional inquiry. AIFE premises subject matter jurisdiction on diversity of citizenship. The complaint alleges that Favorite and Petrovic are citizens of Missouri and the Republic of Serbia, respectively. R.1 at paragraphs 7-8. But the only factual support offered for this conclusion is that Favorite is a "resident" of Missouri and Petrovic is a "resident" of Serbia. R. 1, Paras. 7-8. Residency alone is not enough to establish citizenship for diversity jurisdiction purposes. Rather, what matters is domicile. Dakuras v. Edwards, 312 F.3d 256, 258 (7th Cir. 2002) ("Citizenship for purposes of diversity jurisdiction is domicile, and domicile is the place one intends to remain."). In addition, AIFE alleges that Compass is an LLC organized in Illinois with a principal place of business in Illinois. R. 1 at paragraph 10. An LLC's citizenship for purposes of diversity jurisdiction is the citizenship of each of the LLC's members. Wise v. Wachovia Securities, LLC, 450 F.3d 265, 267 (7th Cir. 2006). But the complaint does not identify the membership of Compass. So the Court orders Defendants to file a Jurisdictional Memorandum that (1) alleges the citizenship (not residency) Favorite and Petrovic; and (2) sets forth the specific identities and citizenship of each individual member of Compass, LLC. The Jurisdictional Memorandum is due by 03/17/2020. Mailed notice (mw, ) (Entered: 03/03/2020)" @default.
