- ilnd;;1:20-cv-01508_de33 RegisterActionDescriptionText "MINUTE entry before the Honorable John J. Tharp, Jr:The City of Chicago's motion for protective order 24 is granted in part and denied in part. For the reasons stated in the City's reply brief, permitting challenges to a party's designation of materials by members of the general public is not appropriate; accordingly, the modification sought by Plaintiffs to 13 of the proposed Confidentiality Agreement is denied. The City's objection to the modification to Paragraph 18 of the proposed order as "unnecessary" is overruled. The Court will, however, substitute the alternative language set forth in the City's reply brief for the originally proposed language of 18. Though the City's position has been largely validated, the Court nevertheless notes that the City's contention that it was not required to consider a possible compromise to resolve Plaintiff's objections is not well-taken. The purpose of the consultation requirement of Local Rule 37.2 is to ensure that the parties to the dispute engage in "good faith attempts to resolve differences." That necessarily includes consideration of potential compromises in an effort to reach an accord. The Court expects that the City, as well as all other litigants, fully explore potential compromises when engaged in the consultation that LR 37.2 requires.
