Defendant Ochoa seeks immediate emergency release from the Metropolitan Correctional Center due to the COVID-19 outbreak 693 (Dkt. 64 in 19 CR 448). Ochoa already contracted the virus, was transported and treated at the hospital, released, quarantined, and has now returned to the population. Therefore, he does not have any immediate concerns because he has recovered from the illness. He complained of arm pain and was transported back to the hospital and was released a second time. Therefore, his medical needs have been addressed and his transport to the hospital each time shows that his medical needs were met. It is true that there was an uptick in infections at the MCC but that only occurred after the Warden chose to test all of the detainees on the two dormitory floors. The vast majority of those detainees tested positive and remarkably did not show any symptoms. In short, the number of detainees that has tested positive does not reflect the relative seriousness of the outbreak. In fact, in two months of the outbreak being handled by the MCC, there have only been seven hospitalizations and four of those have been released. The guards who have tested positive have either recovered and are once again working or remain away from the facility. There have been no deaths. Ochoa, on the other hand, has a violent criminal, including being arrested while on parole for second degree murder, and a pattern of violating release orders. Even when he was being treated at Northwestern Hospital, he was described as violent and aggressive toward the staff. Ochoa remains a danger to the community and his medical needs are being addressed.
