Pallmeyer: Defendant Sheldon Morales has filed an emergency motion for release citing the COVID-19 pandemic and his preexisting asthma condition, a thyroid condition, and the sickle-cell trait. The weight of the evidence in this case and Mr. Morales's significant criminal history militate against release. At the court's direction, the government has furnished Mr. Morales's medical records, including his most recent temperature reading. Those records show that Mr. Morales's conditions are well-controlled. Mr. Morales has not had a temperature check since mid-April, but the court is satisfied by the explanation from MCC officials that more frequent checks yield much less helpful information than does monitoring of symptoms. The court is also satisfied that such monitoring is taking place in that staff are making regular daily rounds and responding when detainees report or appear to have symptoms. The fact that these monitors are not all doctors or nurses does not render this monitoring suspect or ineffective. As explained earlier, the court is generally reluctant to order release of an individual whose record supports detention, if the reason for release is one that would require release of every detainee in the institution.
