Defendant Adewale Adawumi filed for emergency release from the Metropolitan Correctional Center 707 (Dkt. 265 in 18 CR 818) alleging that he is at greater risk of contracting the COVID-19 and having serious complications from it because he has TB. A review of his medical records reveals that he has latent TB which is not acting up at this time. He was detained as both a danger to the community and a flight risk after being charged in a multi-millions dollar fraud scheme. Adawumi is not legally in this country and as such any release that the Court would consider would be for naught since the BOP would need to notify ICE that he has been released and he would be arrested and returned into ICE detention. Most importantly, however, is the Current situation at the MCC. It is true that 133 detainees have tested positive. Yet, of those, 120 have completely recovered. The remaining 17 are on the road to recovery and no one is in the hospital. This shows that the MCC is handling the pandemic well and there are no extraordinary circumstances requiring defendant's release.
