- ilnd;;1:20-cv-01792_de918 RegisterActionDescriptionText "MINUTE entry before the Honorable Gary Feinerman:This order is entered by District Judge Feinerman in his capacity as emergency judge and the assigned judge. Defendant's motion for immediate release to house arrest (Dkt. 898 in Case 20 C 1792) (Dkt. 35 in Case 19 CR 494) is denied without prejudice. First, the sole authority cited by Defendant Lister, 18 U.S.C. 3142(i), does not appear to apply to defendants who, like Defendant Lister, have already pleaded guilty. See United States v. Hartsell, __ F. Supp. 3d __, 2020 WL 1482175 (N.D. Ind. Mar. 25, 2020). Second, even if Section 3142(i) applied to Defendant Lister, release still would be unwarranted. Of the 137 detainees at MCC who have contracted COVID-19, 120 have recovered and the other seventeen are on their way to recovery, showing that MCC currently is handling the situation ably and that there are no extraordinary circumstances that would justify release. The Clerk is directed to terminate the motion on both dockets.Mailed notice. (jlj, ) (Entered: 05/14/2020)" @default.
