Plaintiffs premise subject matter jurisdiction on diversity of citizenship. The complaint alleges that Plaintiffs are citizens of Texas. (Dkt. 1, para. 15.) The only factual support offered for this conclusion, however, is that Plaintiffs "reside" in Texas. (Id., para. 5.) Residency alone is not enough to establish citizenship for diversity jurisdiction purposes. Rather, what matters is domicile. Dakuras v. Edwards, 312 F.3d 256, 258 (7th Cir. 2002) ("Citizenship for purposes of diversity jurisdiction is domicile, and domicile is the place one intends to remain"). Accordingly the Court orders Plaintiffs to file a Jurisdictional Memorandum identifying specific facts in support of subject matter jurisdiction based on diversity of citizenship.
