- ilnd;;1:20-cv-02632_de26 RegisterActionDescriptionText "MINUTE entry before the Honorable Mary M. Rowland: Plaintiff invokes diversity jurisdiction as the basis for this Court's jurisdiction (Dkt. 1). Plaintiff alleges that the membership of Shah Venture "Company" is a single Illinois resident and the membership of Defendant Tenax Energy Solutions LLC is a single Oklahoma resident, and that Kevin Jones is an Oklahoma resident. First, the caption of the complaint states that Shah is an LLC. Therefore, for both Shah and Tenax, Plaintiff must identify each of their members and the citizenships of each of their members as of the date of the filling of the complaint. Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). See also Craig v. Ont. Corp., 543 F.3d 872, 875 (7th Cir. 2008) (court may raise subject matter jurisdiction at any stage of the proceedings). In addition, allegations of residence, as opposed to citizenship, are not sufficient. Slottke v. Wis. Dep't of Workforce Dev., 734 F. App'x 354, 355 (7th Cir. 2018). For individuals, "[c]itizenship means domicile (the person's long-term plan for a state of habitation) rather than just current residence." Myrick v. WellPoint, Inc., 764 F.3d 662, 664 (7th Cir. 2014). Plaintiff shall file a jurisdictional supplement, as a separate docket entry, on or before 9/10/20. Failure to file may result in the case being dismissed for lack of subject matter jurisdiction. Mailed notice. (dm, ) (Entered: 08/28/2020)" @default.
