The Court has reviewed plaintiff's revised complaint 9 under 28 USC 1915(e)(2) to determine if it states a claim upon which relief may be granted. Plaintiff alleges that she was terminated, apparently after she was attacked by a subordinate worker while on the job. Plaintiff asserts a claim for violation of the Americans with Disabilities Act, but her complaint alleges no facts that support a plausible finding that she was terminated because of a disability. A conclusory allegation to this effect is not enough. The only non-conclusory allegations in plaintiff's complaint concerns the attack by the subordinate worker, and those allegations say nothing about disability at all, and nothing that would lead to a plausible finding that plaintiff was terminated because of a disability. The Court therefore dismisses the complaint for failure to state a claim, with leave to amend. The Clerk is directed to send the plaintiff an amended complaint (employment discrimination) form. Plaintiff is given to 10/23/2020 to file an amended complaint that states a plausible claim over which this Court has jurisdiction. If she does not do so, the Court will dismiss the case.
