- ilnd;;1:20-cv-07295_de7 RegisterActionDescriptionText "ORDER: By order of Dec. 16, 2020, the Court directed Plaintiff to either submit a properly completed in forma pauperis application or pre-pay full filing fee (which is now $402.00, not $400.00 as mistakenly stated in that order). Plaintiff was warned the failure to do so by Jan. 13, 2021 would result in summary dismissal of this matter. The Court has received returned mail indicating that Plaintiff has been discharged from the Cook County Jail 6 . Because Plaintiff filed his complaint while he was in custody, the Prison Litigation Reform Act applies, and Plaintiff remains responsible for payment of the full filing fee. Robbins v. Switzer, 104 F.3d 895, 896-97 (7th Cir. 1997). If he wants to proceed with this case, Plaintiff must submit an updated in forma pauperis application that shows his current financial and employment status so that the Court can determine his current ability to pay the filing fee. See id. at 898. Plaintiff also must submit a copy of his trust fund statement from the Cook County Jail showing activity in his account from approximately June 4, 2020, through Dec. 4, 2020. See id. (although prisoner had been released, trust fund account information could still be supplied). The Court directs the Clerk to send Plaintiff a copy of this order and a blank in forma pauperis application (non-prisoner version). The Court extends the deadline for compliance to February 22, 2021. Failure to comply by that date will result in summary dismissal of this matter. Signed by the Honorable Robert W. Gettleman on 1/22/2021. Mailed notice (cn). (Entered: 01/22/2021)" @default.
