- ilnd;;3:04-cv-50072_de17 RegisterActionDescriptionText "MINUTE ORDER of 7/6/04 by Hon. Philip G. Reinhard : On 6/18/04 the court entered an order requiring plaintiff to file amended allegations of subject matter jurisdiction. The amended jurisdictioanl allegations were filed on 7/1/04. The allegations reflect that plaintiff is a limited liability company whose sole member is Mudhouse Management, LLC and that Mudhouse Management, LLC's sole member is Karen Ami. The allegations recite in paragraph 3 that Karen Ami "resides in Sharon, Wisconsin and in Chicago, Illinois." An allegation of residence is not an allegation of citizenship. They are not synonyms, Meyerson v. Harrah's East Chicago Casino, 299 F.3d 616, 617 (7th Cir. 2002), and plaintiff alleges two states of residence even if they were. The citizenship of a limited liability company is that of its members and must be traced through all layers of entities. Myerson v. Showboat Marina Casino Partnership, 312 F.3d 318, 321 (7th Cir. 2002). It is Ms. Ami's citizenship that is controlling and plaintiff has failed to allege her citizenship. Plaintiff has failed to establish subject matter jurisdiction. This case is dismissed for lack of subject matter jurisdiction. mailed notice (jat) (Entered: 07/07/2004)" @default.
