Kapala: In its amended complaint 7 plaintiff now makes sufficient allegations to invoke this court's subject matter jurisdiction pursuant to 28 U.S.C. § 1332(a)(1) over civil actions where the amount in controversy exceeds $75,000 and is between citizens of different states. However, plaintiff persists in pleading that this action is brought pursuant to 28 U.S.C. § 1330(a) and 28 U.S.C. § 1332(a)(2). In addition, plaintiff pleads venue pursuant to 28 U.S.C. 1391(f)(1).Under § 1330(a) this court has original jurisdiction without regard to the amount in controversy of any nonjury civil action against a foreign state. Under § 1332(a)(2) this court has original jurisdiction of all civil actions where the amount in controversy exceeds $75,000, and is between citizens of a State and citizens or subjects of a foreign state. § 1391(f)(1) is a venue provision specifically applicable to a civil action against a foreign state. Despite the foregoing affirmative jurisdictional pleadings, plaintiff has not alleged that defendant is a foreign state, a citizen of a foreign state, or a subject of a foreign state.
