First, Plaintiff seeks a Court order that he does not have to respond to Defendant's interrogatories seeking personal information. That request is DENIED. Plaintiff should serve Defendant with his responses to the interrogatories. If he has an objection to one or more of the interrogatories, he can simply note that and state the grounds for his objection (for example, it is irrelevant). Fed. R. Civ. P. 33(b)(3), (4). If defense counsel still wants to obtain the information despite Plaintiff's objection, he must attempt to work through the dispute with Plaintiff. If the parties are unable to reach a resolution on their own, then defense counsel can file a motion to compel and the Court will decide the issue. For his second request, Plaintiff asks the Court to reverse the previous Order extending the deadlines for discovery and dispositive motions. That request is also DENIED. The extension of time was necessary. Discovery on the merits of Plaintiff's claim was stayed pending resolution of Defendant's motion for summary judgment on the issue of exhaustion (Doc. 43, para. 4). That motion was eventually denied and the stay was lifted, (Doc. 65), meaning the parties are now free to conduct merits-based discovery.
