- ncmd;;1:16-cv-01078_de100 RegisterActionDescriptionText "TEXT ORDER adopting 72 Rule 26f Report - Individual by Defendants and 73 Rule 26f Report - Individual by Plaintiff to the extent they coincide and adopting these provisions as to matters of disagreement (as determined at the Initial Pretrial Conference held this day): (1) each side may conduct up to 15 depositions (excluding any disclosed experts); (2) the parties shall conduct a meet and confer regarding the scheduling of depositions by 08/21/2017; (3) consistent with Federal Rule of Civil Procedure 26(d)(2), the Court imposes no restriction on whether depositions may begin prior to the exchange of written discovery, but the Court encourages the parties to work cooperatively to avoid inconvenience to witnesses (including considering the obligations of the witnesses in connection with related or similar cases); (4) the parties shall file any motion seeking leave to amend pleadings (beyond the addition of parties, which may occur up to 01/29/2018) by 11/30/2017; (5) regarding the medical records of Decedent Bethann Woodell and/or Plaintiff Jerry Woodell, (a) on or before 08/07/2017, Defendants shall serve Plaintiff with any request(s) for production of documents for medical records (including mental health-related records) and/or signed releases for such records, (b) on or before 08/14/2017, Plaintiff shall produce the documents and/or signed releases requested by Defendants that Plaintiff committed to produce in Paragraph V of 73 Report and shall serve Defendants with any objection(s) Plaintiff may wish to present to any other aspect of any such request(s) (including the time period of any such request(s) and the discoverability of mental health-related records), (c) on or before 08/21/2017, the parties shall conduct a meet and confer regarding any such objections served by Plaintiff, (d) on or before 08/31/2017, Defendants shall file any motion to compel regarding any remaining dispute over such objections, (e) on or before 09/10/2017, Plaintiff shall file any response to any such motion to compel, and (f) on or before 09/15/2017, Defendants shall file any reply to any such response; and (6) at this time, the Court declines to adopt the electronic discovery-related certification requirement and deadline proposed by Plaintiff in Paragraph V of 73 Report.
