- ncmd;;1:17-cv-01116_de119 RegisterActionDescriptionText "ORDER signed by JUDGE CATHERINE C. EAGLES on 01/21/2020, that: 1. The defendant's motion in limine "to exclude evidence related to lost wages," Doc. 63 , is DENIED. 2. The defendant's motion in limine "to preclude the plaintiff from presenting hearsay testimony and exhibits related to Annika Slade," Doc. 65 , is GRANTED, but this does not preclude the plaintiff from calling Ms. Slade to testify about matters within her personal knowledge. 3. The defendant's motion in limine "to exclude ADE5D49 opinions and legal conclusions," Doc. 67 , is DENIED, without prejudice to objections to specific questions or answers at trial. A wholesale prohibition on the use of the word "reasonable" by the plaintiff during his testimony would not be sensible, but neither will the plaintiff be allowed to offer opinions about legal issues which are not grounded in his personal experience and knowledge. 4. The defendant's motion in limine "to exclude evidence relating to plaintiff's left arm paralysis and stray remarks and incidents," Doc. 69 , is DENIED. While it is clear from a review of the amended complaint and the summary judgment briefing that this case is largely about the plaintiff's ADHD and scheduling issues, the plaintiff explicitly alleged that the refusal to provide furniture polish was a failure to accommodate his left arm disability, Doc. 16 at 21, 41. The defendant did not address this claim in its brief in support of summary judgment, Doc. 41 , and addressed it in its reply brief only in terms of the plaintiff's claim for wrongful termination, not failure to accommodate. See Doc. 47 at 10. The fact that the Court did not mention in its summary judgment order the furniture polish/left arm failure to accommodate claim specifically does not mean that this claim was somehow dismissed without discussion.
