In Plaintiffs' Reply, they inform the Court that Defendant's supplemental responses to Interrogatory No. 14 "are sufficient and the Motion to Compel is now moot." See Doc. 107. However, Plaintiffs rightly point out that they "should not have to incur expense and delay to file unnecessary motions to compel the United States to follow the rules of discovery. The Court, likewise, should not have its docket clogged with unnecessary motions." Id. Moreover, Federal Rule of Civil Procedure 37(a)(5)(A) states that, if discovery is provided after the filing of a motion to compel, the Court "must" award "reasonable expenses incurred in making the motion, including attorney's fees" unless certain circumstances apply. Therefore, within 7 days of the entry of this Order, Plaintiffs shall submit to the court's proposed text email address a proposed form of order finding their motion as moot and expressly stating whether they intend to seek their reasonable expenses or if they will be waived.
