- nysd;;1:16-cr-00453_de151 RegisterActionDescriptionText "ORDER: On September 8, 2017. the Court sentenced Defendant 976449F to, inter alia, 25 years' imprisonment for his role in a conspiracy to transport approximately 1.3 tons of cocaine on the high seas in violation of 46 U.S.C. § 70503, et seq. On the same day, the Court received a motion from Defendant requesting leave to proceed in forma pauperis on appeal in this matter. (Doc. No. 121.) Because (1) Defendant was previously found to be indigent and to qualify for the appointment of counsel pursuant to the Criminal Justice Act, 18 U.S.C. § 3006A (Doc. No. 7), and (2) under Federal Rule of Appellate Procedure 24(a), a defendant who previously "was determined to be financially unable to obtain an adequate defense in a criminal case... may proceed on appeal in forma pauperis without further authorization," Defendant's motion to proceed in forma pauperis on appeal is unnecessary. Accordingly, the Clerk of Court is respectfully directed to tem1inate the motion pending at docket number 121. SO ORDERED. (Motion Terminated: 121 LETTER MOTION as to 976449F (3)) (Signed by Judge Richard J. Sullivan on 9/12/2017) (lnl) (Entered: 09/13/2017)" @default.
