ORDER: On June 21, 2017, Defendant Joseph Merlino submitted a letter to the Court requesting access to all status updates provided to the Court regarding an administrative inquiry being conducted by the Federal Bureau of Investigation ("FBI"). (Doc. No. 852.) On June 22, 2017, the Court ordered the government to respond to Defendant Merlino's request for access to the status updates. (Doc. No. 855.) On June 27, 2017, EC5568A sent the attached letter to the Court renewing his request to unseal documents related to the administrative inquiry and requesting access to the status updates as well. The Court is now in receipt of a letter from the government dated June 28, 2017, which includes a letter dated June 27, 2017 from Lisa K. Matsumoto, Unit Chief of the Investigative Law Unit of the FBI's Office of the General Counsel, as an exhibit. (Doc. Nos. 861, 861-1.) The two letters explain that the FBI wishes to provide status updates regarding the administrative inquiry directly to the Court, and objects to disclosure of the updates to the parties in this matter in accordance with a "general rule" that the FBI does not disclose details to outside counsel during the pendency of internal investigations. Neither the government nor the FBI offer authority for the government's apparent outsourcing of its representation in this action. Moreover, the FBI's letter is wholly conclusory, without citation to any relevant legal authority or even an acknowledgment of the standard to be applied in considering Defendant Merlina's request for access to the status updates. Accordingly, IT IS HEREBY ORDERED that, by Friday, July 7, 2017, the government shall submit an amended response to the Court's June 22, 2017 order that addresses the arguments set forth in Defendant Merlina's June 21, 20 17 letter and Mr. EC5568A June 27, 2017 letter.
