Defendants have opposed, (Doc. 160), raising two procedural barriers that appear to the Court to be valid. Plaintiff has not replied or otherwise indicated that those procedural barriers do not exist or can be overlooked. Essentially for the reasons stated by Defendants, the motion is denied. Further, this would not in any event be a case in which I would be inclined to overrule the jury's finding. There was evidence supporting both sides and I cannot say that the jury's credibility determination or verdict was a miscarriage of justice or egregiously erroneous. See, e.g., DLC Mgmt. Corp. v.
