It is therefore ORDERED: (1) Plaintiff's claims against Defendants Adam D. Gonzales, Jimmy S. Webb, and Larry G. Boyle are dismissed with prejudice for failure to state a claim; (2) Plaintiff's claims for compensatory monetary damages are dismissed with prejudice pursuant to 28 U.S.C. § 1915(e)(2)(B)(ii) and 1915A(b)(1); (3) It appears that Defendant Timothy Hooper is an employee of the State of Texas and is likely to be represented by the Office of the Attorney General for the State of Texas. Within thirty (30) days from the date the Law Enforcement Defense Division of the Texas Attorney General's Office receives this Order, Defendant Timothy Hooper shall file a written answer or response to Plaintiff's individual capacity claims that Defendant Hooper violated Plaintiff's Eighth Amendment rights while he was incarcerated in Administrative Segregation in the Robertson Unit; (4) The Clerk shall transmit a copy of Plaintiff's Final Amended Civil Rights Complaint 30 , the More Definite Statement 32 , and the Report and Recommendation of the United States Magistrate Judge 36 , along with a copy of this Order, to the appropriate e-mail addresses at the Office of the Attorney General for the State of Texas; (5) In the event that Defendant Timothy Hooper is no longer employed by the TDCJ and the Attorney General is unable to obtain consent to file a response on his behalf, the Office of the Attorney General shall, on or before June 7, 2018, obtain the last-known address from the TDCJ for Defendant Hooper and provide the same to the Court, UNDER SEAL AND WITHOUT A MOTION, for the Court's in-camera examination only, subject to further orders of this Court. Furthermore, such address shall not be disclosed in any manner to Plaintiff, and if any documents containing the address, including returns of service of summons, are sent to Plaintiff, such information shall be redacted; (6) The caption of this case shall be changed to 1EF6C8A v. Timothy Hooper; (7) Any Pending motions are denied; (8) No further motions or pleadings may be filed by Plaintiff until after Defendant has answered or otherwise pleaded and the Court has entered a scheduling order; (9) Pursuant to Federal Rule of Civil Procedure 54(b), the Court finds that there is no just reason for delay in entering final judgment and judgment shall be entered accordingly.
