EB03C3D and 97179AB request that the Court order "1. That the United States Marshal Service transfer EB03C3D and 97179AB from the facilities where they are currently detained to the Federal Detention Center at Seagoville; 2. That the authorities at the Federal Detention Center at Seagoville make reasonable arrangements that allow EB03C3D and 97179AB to jointly meet with undersigned counsel on a reasonable schedule; 3. That contact between Defendants EB03C3D and 97179AB be permitted during and for the purpose of attorney-client meetings; [and] 4. That the location in which these Defendants are housed, be it Seagoville or otherwise, permit the use of electronic devices for purposes of reviewing discovery and preparing for trial." Dkt. No. 222 at 12-13. The government "is opposed to the defendants' request to be housed in the same facility, but not opposed to their request to be housed in facilities closer to their respective attorneys' offices." Dkt. No. 222 at 15. The Court is generally not in the business of directing where the Marshals Service places defendants who have been ordered detained pending trial. But this case is unusual because, in a case involving large volumes of electronic discovery, the government sought, and the Court entered, a Protective Order Governing Disclosure of Discovery Materials 187 that provides that "[a]ny discovery materials (or copies thereof) provided by the government to the defense (regardless of when such materials were produced): (a) will not be copied, except to the extent needed as trial exhibits or as counsel's working copies; (b) will not be shared outside of the defendant's counsel's office, or the correctional facility library, with any person not employed by defendant's counsel; [and] (c) will not be provided to, or kept by, a defendant, except that defendant's counsel may take the materials to a defendant and show them to a defendant." Dkt. No. 187 at 2. Counsel for EB03C3D and 97179AB also represent to the Court that, "based on the nature of the case and their understanding of the factual and legal issues involved, it will be necessary for all counsel to jointly meet with EB03C3D and 97179AB to review discovery, discuss the facts of the case, and make intelligent decisions about trial strategy." Dkt. No. 222 at 10. Based on these unique circumstances, the Court determines that the Joint Motion for Court to Order United States Marshals Service to House Defendants at the Same Facility 222 should be, and is, GRANTED IN PART and orders that the United States Marshals Service transfer Defendants EB03C3D and 97179AB from the facilities where they are currently detained to a facility that will permit the use of electronic devices for purposes of reviewing discovery and preparing for trial and that will make reasonable arrangements that allow Defendants EB03C3D and 97179AB to jointly meet with their counsel on a reasonable schedule but otherwise house Defendants EB03C3D and 97179AB separately and keep them completely separated from each other with the exception of times that they are in joint meetings with their counsel. The appropriate facility may be the Federal Detention Center at Seagoville, but the Court does not intend to involve itself in the Marshals Service's placement of pretrial detainees any more than necessary and will leave the determination of an appropriate facility that can accommodate these requirements to the Marshals Service.
