- W102169155 abstract "Standing on Its Head: The Problem of Future Claimants in Mass Tort Class Actions^ Introduction: Standing on Shaky Ground In one of the most important class action decisions in recent years, the Supreme Court in Amchem Products, Inc. v. Windsor1 decertified a nationwide class of asbestos claimants.2 The class included hundreds of thousands, if not millions of people who had been exposed, or whose family members had been exposed, to asbestos.3 Most of these claimants manifested no current injuries and were classified as plaintiffs.4 Objectors to this settlement class action raised several jurisdictional issues-including standing-with regard to these exposureonly plaintiffs, but those issues were not met by the Supreme Court, and the case was decided on other grounds.5 Thus, the standing of exposureonly future claimants remains undecided at the Supreme Court level.6 Several lower courts, however, seem to have resolved this issue by recognizing standing-either explicitly or implicitly'-for future injury plaintiffs in mass tort class actions. For example, the district court in Amchem held that future claimants had standing.8 Recently, the Fifth Circuit implicitly recognized standing for a class consisting almost exclusively of future claimants.9 Other courts have also recognized future injury standing in the mass tort class action context.'o There are at least a couple cases in which standing has been denied to exposure-only claimants, but these examples do not usually involve mass tort class actions.11 The purpose of this Note is to defend a bright line denial of standing to exposure-only claimants in mass tort class actions who seek compensation for their future injuries.'2 Not only is such a rule the fairest solution given the competing considerations of currently injured plaintiffs and defendants seeking to extinguish their liability, but it is also the result most consistent with standing policies and precedent. Standing issues raised by classes of future claimants in mass tort class actions who have been exposed to harmful agents but who presently manifest no current injury fall within the scope of this Note. '3 This Note incorporates related issues of justiciability such as mootness and ripeness where appropriate.14 Part II summarizes current standing doctrine, including its evolution, underlying policies, and the criticism it has received. Part III explores the problem of the future claimant in the mass tort arena, and argues that the current situation (in which standing issues are either unaddressed or resolved in favor of standing) is an undesirable one. Part IV explains why standing should be denied categorically to future claimants in mass tort class actions, both in terms of standing precedent and policies and because the result would have desirable side effects such as a more accurate valuation of current and future claims. Part V defends these recommendations and briefly recommends a solution outside of the courts and bankruptcy that defendants could investigate to solve the problem of future claims. II. Standing in the Background: A Brief Description of the Doctrine According to the Court, Generalizations about standing to sue are largely worthless as such.'5 Whether that generalization itself is worthy or not, this Part attempts to outline briefly the contours of relevant standing doctrine. The eventual thrust of this Note's argument, however, is that typical standing analysis is inappropriate in the mass tort class action context. 16 A. The Current Understanding Standing is one aspect of the doctrine of justiciability, which determines the cases that courts can legitimately hear.17 Other aspects of justiciability include the doctrines of ripeness, mootness, advisory opinions, and political questions.18 What standing specifically deals with is the party to a lawsuit, rather than the claim; standing inquiries ask whether this party is the proper party to bring this lawsuit. …" @default.
