• W103417476 abstract "Russian Abstract: В данной статье рассматриваются теоретические и связанные с ними практические аспекты электронной демократии и электронного голосования. Электронная демократия – понятие в целом общеизвестное, однако в силу своей многоаспектной природы, в целом малоизученное. Совет Европы в соответствующей рекомендации в 2009 году определил основные правовые параметры электронной демократии, в числе которых повышение участия населения в демократических процессах, обеспечение прозрачности и подотчетности государственных органов, дистанционное взаимодействие и электронный документооборот. Развитие различных практик и инструментов электронной демократии приобретает в общемировой практике все большие масштабы. В Российской юридической науке данной теме не уделяется должного внимания.Электронная демократия в зарубежной практике постепенно расширяется, охватывая вопросы не только государственного, но и общественного самоуправления. Это наглядно подтверждается проведенной автором классификацией практик, инструментов и проектов электронной демократии. В числе них автор выделяет различные проекты, в том числе еще в целом не известные в отечественной демократической практике.Многие авторы относят электронную демократию к чисто политической сфере, а именно к определению оптимальных методов и способов демократического управления. Между тем электронная демократия, по мнению автора, имеет ярко выраженные правовые истоки. В статье комплексно и системно исследована правовая сущность электронной демократии с привлечением зарубежных источников, ранее не переведенных и не использованных в отечественной юридической науке.В заключении автор статьи впервые в отечественной юридической науке разработал правовое понятие электронной демократии, исходя из целого ряда принципов, составляющих основу понятия электронное управление. В статье излагается понятийный аппарат, особенности правового регулирования, дается правовая оценка возможностей развития электронного голосования в системе электронной демократии. Автором сформулирован ряд основополагающих идей, лежащих в основе понятия электронной демократии и определяющих основы правового регулирования в данной области.English Abstract: This article examines theoretical and related practical aspects of e-democracy and e-voting. E-democracy -- a concept well-known in general, but because of its multidimensional nature, generally insufficiently studied. Council of Europe recommendation in 2009 defined the basic legal parameters of e-democracy, including raising the people's participation in democratic processes, transparency and public accountability, remote communication and electronic workflow. Development of various practices and tools of e-democracy acquires global practice increasing scale. In the Russian legal science topic has been neglected.E-democracy in foreign practice gradually expanding into issues not only the state, but also public authorities. This clearly confirms the author’s classification practices, tools and e-democracy projects. Among them, the author highlights the various projects, including still not generally known in the national democratic practice.Many authors refer to the e-democracy purely political sphere, namely to the definition of best practices and methods of democratic governance. Meanwhile e-democracy, according to the author, has pronounced legal origins.This article comprehensively and systematically investigated the legal essence of e-democracy with involving foreign sources not previously translated and used in the national legal science.In conclusion, the author for the first time in the national legal science developed the legal concept of e-democracy, based on a series of principles that form the basis concept of e-government. The article describes the conceptual apparatus, peculiarities of legal regulation, given the legal assessment of the possibilities of e-voting system in the system of e-democracy. The author articulates the range of fundamental ideas underlying the concept of e-democracy and defining the foundations of legal regulation in this area." @default.
