This article reviews default judgment statute; examines requirement that plaintiff submit proof of facts of its claim; and surveys case law regarding consequences of plaintiffs failure to submit sufficient proof of its claim. I. CPLR 3215--THE DEFAULT JUDGMENT STATUTE CPLR 3215 permits plaintiff to seek default judgment against defaulting defendant, (4) but requires plaintiff to do so within one year of default. (5) Where the plaintiffs is for certain or for which can by computation be made certain, plaintiffs application for default judgment may be made to clerk of court. (6) Only narrow class of claims may be submitted to clerk. In this regard, statute contemplates a situation in which ... there can be no dispute as to amount due, as in actions on money judgments and negotiable instruments. (7) Thus, causes of action seeking unliquidated damages--such as torts (8)--or equitable relief (9) do not fall within that reserved class. If complaint (or summons with notice) asserts any other than one for sum certain, plaintiffs application for default judgment must be made to court. (10) The plaintiff must, regardless of type of involved, submit following on its application for default judgment: (1) proof of service of initiatory papers on defendant; (2) of facts constituting claim and, if damages are sought, amount due; and (3) proof of default. (11) As to items one and three, process server's affidavit demonstrates proof of service of summons and complaint or summons with notice, (12) and proof of default should be supplied by plaintiffs attorney because attorney, rather than client, generally has firsthand knowledge of default. (13) As to item two, proof of must be supplied by someone with personal knowledge of facts underlying claim.
