For the first two years of the five- year probationary period, the school board renewed Cowan's contract on the recommendation of her principal, Lucille Cogdill. In May 1992, on the last day of school for her second year. Cowan had sent the following letter home with each of her students: Dear Second-Grader: You have completed second grade. Because you worked so hard, you deserve something special and unique; just like you! That something special is your very own magic rock. The magic rock . . . will always let you know that you can do anything that you set your mind to. To make your rock work, close your eyes, rub it and say to yourself three times, I am a special and terrific person, with talents of my own! Before you put your rock away, think of three good things about yourself. After you have put your rock away, you will know that the magic has worked. HAVE FUN lN THIRD GRADE!!!! Attached to each student's letter was a rock. In August 1992. Cogdill informed Cowan that she had received complaints from parents regarding this letter. In particular, two families had decided to move their children to private Christian schools as a direct result of the letter. Cogdill admonished Cowan to avoid magical ideas in her teaching. She ended the meeting by identifying two job targets or areas for improvement: 1) interpersonal relations with parents and 2) instructional process. At the beginning of the 1992-93 school year, Cogdill held a faculty meeting in which she informed the teachers that she was concerned about the community's perception that the school was teaching New Ageism, and she instructed them to avoid magical notions in their teaching. She also announced an upcoming meeting coordinated by a local pastor, Reverend Stark, that was to be devoted to the issue of New Ageism and its infiltration into the public schools. Stark had visited Cogdill during the summer, after his granddaughter brought home the magic rock letter. He explained that he considered it contrary to his religious beliefs. Similarly, another local clergy member, Reverend Vawter, had publicly warned his congregants that a teacher in the school system was teaching New Ageism to students through the use of magic rocks. Cogdill subsequently attended Stark's meeting and defended the school against attacks that it was practicing anti-Christian, New Age modes of teaching. During the rest of the 1992-93 school year, Cowan's third at the school, Cogdill showed only lukewarm support for Cowan in her efforts to improve her teaching. In March 1993, on the eve of the school board's vote on her contract renewal, Cogdill told Cowan that she was recommending nonrenewal and suggested to her that she resign rather than be nonrenewed. Cowan did not resign. The board met in an executive session attended by Cogdill and voted unanimously not to renew Cowan's contract. In June 1994, after obtaining a right-to-sue letter from the Equal Employment Opportunities Commission, Cowan filed suit in federal court against the school district, alleging that the board's decision constituted religious discrimination under the Equal Employment Opportunities Act, which is Title VII of the Civil Rights Act. She also claimed that the board's action violated her freedom of speech under the First Amendment of the U.S. Constitution. In August 1996, the jury returned a verdict for Cowan on the Title VII religious discrimination claim, with damages in the amount of $18,000. The jury also returned a verdict in her favor on the First Amendment claim but awarded no damages. The judge denied the school district's post-verdict motions, including a motion for relief from judgment based on the allegation that she had committed perjury in her testimony. …" @default.
