- W118766992 abstract "The ‘loss and damage caused by climate change’ is recognized as an issue in the international negotiations on climate change, under the UNFCCC based conferences of the parties, also known as COPs. The United States and other likeminded states opposed the use of the term ‘loss and damage’ when negotiating the text of the COP 18 in Doha 2012. At the same time, many states appreciated the use of phrase ‘protection against loss and damage caused by climate change’ in the COP18 decision, by describing the use of the term as a significant step towards a new climate treaty. However, the issue of ‘loss and damage’ is not only controversial but also difficult to include in a treaty, but will be discussed for the first time in depth at the COP 19, in Warsaw, 2013. It remains to be seen how the liability for compensation of loss and damage caused by climate change will be included in the new climate treaty to be concluded in 2015 and implemented from 2020. The legal protection against loss and damage caused by climate change is one of the critical legal issues of the present time, involving a number of serious questions, e.g. who is responsible for the climate harm and how could the climate victims, whether they are states or individuals, be compensated by the harming states or individuals? Is it possible to hold fossil fuel industries liable for climate harm? If not, what is the difference between the COP18 decision, known as 'damage aid' and ‘official development aid’? In what sense does 'damage aid' differ from 'green climate fund' and 'long term finance' in mitigating climate change? Will the least developed countries and the small Island countries receive funds to repair ‘loss and damage’ incurred as a result of climate change by a simple pledge made by industrial states? If the future COP decision(s) is simply going to be a policy statement, what is the relevance of such a decision in terms of legal ‘injury’, ‘harm’ and ‘compensation’ to victims? The seriousness of injuries, or significant harm (damage), becomes the legal relevance in any legal case. However, it is difficult, if not impossible, to prove a case of climate harm, linking any specific anthropogenic emissions with any specific injury from a particular company or states due to the cumulative nature of the emission effect. Thus, keeping in view the difficulties and risks associated with climate change litigations, I will explore how some national courts have dealt with cases of climate harm and compensation, as well as what lesson can be learned from those decisions." @default.
